Attorney Brandon S. Atwater Settles Workers’ Comp Claim Against Employer FedEx in Work-Related Assault Case

DURHAM, NC- After nearly a year and a half after a workplace violence incident, Attorney Atwater wins an unprecedented settlement for client in Workers’ Compensation Case against FedEx Ground Package System, Inc.
On or about May 12, 2016, Atwater’s client, who was a manager and career employee with FedEx at, was brutally assaulted by a subordinate employee. As a result of the attack, the client sustained sunstained significant physical bodily injury. In addition, given the traumatic nature of the attack, the client also suffered ongoing severe emotional and psychological injuries.
The employer, who was represented by Third-Party Administrator Sedgwick Claims and MGC Insurance Defense, resisted their obligation to provide the client medical compensation for over a year. After unsuccessfully attempting to handle the claim on his own, the client retained Attorney Brandon S. Atwater to his workers’ compensation claim. Thereafter, Attorney Brandon S. Atwater filed a motion to set the matter for hearing.
The client, who was discharged shortly after the incident which led to his injuries, has also filed a claim for retaliatory discrimination and wrongful discharge in violation of public policy, which is currently pending in Durham County Superior Court. Attorney Brandon S. Atwater will represent the client with respect to those claims as well.
